If you want to erect a billboard to advertise third party advertisements (third party advertisements are by any/all parties not being in physical occupation of the property on which the sign is to be erected or to which the sign is to be affixed) or to advertise yourself, in order to obtain additional income, you have to adhere to the requirements and criteria as stated in the “Policy on Outdoor Advertising Control”, approved by Council. In many instances there are uncertainties on how and where these boards may be erected. Council has rules and regulations implemented in conjunction with certain criteria and guidelines on how any advertisement, which is visible to the public, should look and where it may be located.
What is a billboard?
A billboard means any screen or board larger than 4.5m2, supported by a structure, which is to be used or intended to be used for the purpose of posting, displaying or exhibiting an advertisement and can be classified as a small, large or super billboard. This is stated in the “Policy on Outdoor Advertising Control”. If the sign is visible from any street or public place, it is seen as an outdoor advertising sign and approval should be obtained from Ekurhuleni Metropolitan Municipality (EMM) prior to erecting such a sign.
The “Policy on Outdoor Advertising Control” of EMM contains detail on the requirements and criteria for any billboard advertisement, which include the following main criteria :

Billboards can be allowed inside metropolitan road reserves, with specific attention to:
Road Safety (Section 17), combination and clutter of advertising, environment impact, but not adjacent to areas of maximum control. |

- Super Billboards should be spaced at least 1 km apart on roads with a speed limit > 80 kph, if visible from each other.
- Super Billboards should be spaced at least 250m apart on roads with a speed limit > 80 kph, if visible from each other.
- Large Electronic Billboards (> 18m2) should be spaced at least 5 km apart on any road.
- Electronic Billboards of 18m2 or smaller in area should be spaced at least 1.5 km apart on any road.

- Approval by EMM will only be granted for a specific period,
- The clear height of the advertising structure shall not be less than 2.4m,
- An advertising impact assessment shall be required for specific billboards,
- Illumination of any billboard is only allowed if the road where it is located, is illuminated, and only if it does not constitute a road safety hazard or cause undue disturbance.
What should you do when you want to erect a billboard - third party/ primary right advertising sign?
If you have already transgressed the Policy in any way, or if you want to erect a billboard, advertising a third party or yourself, you can obtain application forms and pay the relevant fees at your nearest Service Delivery Regional Offices. Advice, as well as full detail on the Policy, criteria and requirements on the specific sign that you want to erect, can be obtained from these Offices. If any illegal signs are observed by the Outdoor Advertising Regional Office, the sign may be removed and you as the owner of the sign will be fined for the offense.
